NEW DELHI, Feb 22: In a relief to the Mumbai-based stand-up comedian Kumal Kamra, the Supreme Court on Monday adjourned the criminal contempt proceedings against him for four weeks on his alleged tweets against the judiciary.
On a request by one of the petitioners for an adjournment, a 2-judge Bench of Justices Ashok Bhushan and R S Reddy ordered: "List fter four weeks along with other connected matters."
The proceedings were initiated against Kamra after he refused to apologise for various tweets, including one calling the Supreme Court as "the supreme joke of the country" while commenting on it granting interim bail to Arnab Goswami of the Republic TV.
Attorney General (AG) KK Venugopal had last year granted his consent to initiate contempt proceedings against him for his alleged tweets against the judiciary.
The consent for contempt proceedings was given after multiple letters of requests were written to Venugopal, including those from Aurangabad-based law student Shrirang Katneshwarkar, advocate Rizwan Siddiquee, Lucknow-based advocate Anuj Singh, and Pune-based lawyers Amey Abhay Sirsikar and Abhishek Sharad Raskar.
In an affidavit, Kamra pleaded not to over-estimate his ability to shake the foundations of the most powerful court in the world, asserting that "the public faith in the judiciary is founded on its own actions and not on any criticism or commentary."
Mincing no words, Kamra had said the idea that any institution of power in a democracy is beyond criticism is like saying that the migrants need to find their way back home during an ill-planned nationwide lockdown. Such an idea is irrational and undemocratic, he said.
"Just as the Supreme Court values the faith that public places in it, it should also trust the public not to form its opinions of the Court on the basis of a few jokes on Twitter," the affidavit said. Jokes are used to make the people laugh and they should be treated like that, it said.
